Terms of Service
Last updated: May 4, 2026These Terms of Service govern your access to and use of the Virtual 360 ADS platform. Please read them carefully before subscribing or using the Service. By creating an account, you confirm that you have read, understood, and agreed to be bound by these Terms.
1. Acceptance of Terms
- By accessing or using Virtual 360 ADS ("the Service"), you agree to be bound by these Terms of Service ("Terms").
- If you disagree with any part, you may not access the Service.
- These Terms apply to all visitors, users, and subscribers.
- We may update these Terms periodically. Continued use after changes constitutes acceptance.
- Material changes will be notified via email and/or prominent notice on the platform.
2. Description of Service
- Virtual 360 ADS is a SaaS platform for digital marketing intelligence and unified ad management.
- The platform allows users to connect advertising accounts (Google Ads, Meta Ads, and others), view unified analytics, manage campaigns, track conversions, and automate marketing workflows.
- Features vary by subscription plan (see Section 5).
- Some features use artificial intelligence (Google Gemini API) to generate insights and recommendations based on your aggregated campaign data.
3. Account Registration and Security
- You must provide accurate, complete, and current information during registration.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must notify us immediately of any unauthorized use of your account.
- You are responsible for all activities that occur under your account.
- One person or entity may maintain only one account.
- You must be at least 16 years old (or the minimum age in your jurisdiction) to create an account.
- We reserve the right to refuse registration or terminate accounts at our discretion.
4. Team Members and Access Control
- Account owners can invite team members with defined roles (Admin, Manager, Analyst, Viewer).
- The account owner is responsible for team members' compliance with these Terms.
- Each role has specific permissions that control access to platform features.
- The account owner can modify or revoke team member access at any time.
5. Subscription Plans and Pricing
- Virtual 360 ADS offers three subscription plans: Starter, Professional, and Enterprise. Each plan includes a specific set of features, platform integrations, and support levels as described on our pricing page.
- In addition to standard plans, users may create a Custom plan by selecting individual modules from our catalog. Custom plans are billed based on the modules chosen.
- Our module catalog includes: advertising platform integrations (such as Google Ads, Meta Ads, TikTok Ads, LinkedIn Ads, X Ads, Pinterest Ads, Snapchat Ads, Amazon Ads, Microsoft Ads, Taboola, and Outbrain), analytics tools (Google Analytics GA4, Google Search Console, YouTube Analytics), marketing tools (Social Media Manager, AI Images Basic, AI Images Pro, Marketing Intelligence), and automation tools (Conversion Tracking, Abandoned Cart). Four modules are included at no additional cost with all plans: PageSpeed Insights, Google Business Profile, Bing Webmaster Tools, and SEO Analysis.
- Prices are displayed in Brazilian Reais (BRL) for users located in Brazil and in US Dollars (USD) for users in all other regions. Currency is determined automatically based on your geographic location and cannot be manually changed.
- All prices are listed on our pricing page. Virtual 360 ADS reserves the right to modify pricing at any time. Active subscribers will be notified at least 30 days before any price change takes effect. Price changes do not apply to the current billing cycle.
- Subscriptions are available in monthly or annual billing cycles. Annual billing offers a discounted rate compared to monthly billing.
6. Free Trial
- Virtual 360 ADS offers a free 7 day trial period. No credit card or payment information is required to start a trial.
- The trial is available in four modes: Starter, Professional, Enterprise, or Custom (with individually selected modules). The trial mode determines which features are accessible during the trial period.
- During the trial, usage is subject to the following limits: 30 AI generated images, 50 marketing intelligence analyses, 5 platform integrations (OAuth), 3 support tickets, and 2 team member invitations.
- To prevent abuse of the trial system, Virtual 360 ADS employs multiple verification methods including tax identification (CPF/CNPJ for Brazil), IP address monitoring (limited to 3 trials per IP address within a 30 day period), device fingerprinting, and email uniqueness verification.
- You will receive a notification on the 5th day and again on the 7th (final) day of your trial. After the trial period expires, access to premium features is suspended until a paid subscription is activated.
- Trial conversion (activating a paid subscription) is processed through Stripe. No trial extension or repeated free trial is available for the same account.
- After trial expiration, your data is retained for 30 days to allow you to subscribe without losing your work. After the 30 day retention period, trial data may be permanently deleted in accordance with our data retention policies.
7. Billing and Payment
- Payments are processed securely by Stripe Inc. We do not store credit card numbers or full payment details on our servers.
- Billing cycles are either monthly or annual, as selected at checkout.
- Monthly subscriptions are billed on the same date each month.
- Annual subscriptions are billed once per year on the subscription anniversary date.
- All payments are non refundable except as described in Section 8 (Cancellation).
- Failed payments: if a payment fails, we will attempt to charge the card again. If payment remains unsuccessful, access to premium features may be suspended until payment is resolved.
8. Cancellation and Refunds
- You may cancel your subscription at any time from the Billing section of your account.
- Monthly subscriptions: upon cancellation, you retain access until the end of the current billing period. No refund is issued for the remaining days.
- Annual subscriptions: upon cancellation, you retain access until the end of the current annual period. No prorated refund is issued for the remaining months.
- After the access period ends, your account reverts to limited access (no premium modules).
- Your data is retained for 30 days after cancellation to allow for reactivation. After 30 days, data associated with premium features may be deleted.
- To permanently delete your account and all data, use the Account Deletion feature in Settings.
9. Upgrades, Downgrades, and Proration
- You may upgrade or downgrade your plan at any time.
- Upgrade: the price difference is prorated and charged immediately for the remainder of the current billing period. New features are available immediately.
- Downgrade: a prorated credit is applied to your next invoice. Features exclusive to the higher plan become unavailable at the next billing cycle.
- Module additions (a la carte): additional modules can be added to any plan. They are billed monthly at their listed price, prorated for the first billing period.
- Module removals: removing a module generates a prorated credit on your next invoice. Access to the module ends immediately upon removal.
10. Acceptable Use
You agree NOT to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Attempt to gain unauthorized access to the Service, other accounts, or systems connected to the Service.
- Interfere with or disrupt the integrity or performance of the Service.
- Upload or transmit viruses, malware, or any destructive code.
- Use the Service to send unsolicited communications (spam).
- Scrape, crawl, or use automated means to access the Service without our written consent.
- Reverse engineer, decompile, or disassemble any aspect of the Service.
- Resell, sublicense, or redistribute the Service or any data obtained through it.
- Use the Service to infringe on intellectual property rights of others.
- Share your account credentials with unauthorized parties.
- Use the API keys (Enterprise plan) in a manner that exceeds rate limits or violates our API documentation.
- Misrepresent your identity or the purpose of your account.
11. API Usage (Enterprise Plan)
- API access is available exclusively to Enterprise plan subscribers.
- API keys are cryptographically generated and stored as SHA 256 hashes (the full key is shown only once at creation).
- You may create up to 5 API keys per account.
- API keys must be kept confidential and not shared publicly.
- Rate limits apply per API key as configured in your settings (default: 60 requests per minute, maximum: 1,000 requests per minute).
- We reserve the right to revoke API keys that are misused or that compromise system integrity.
- You are responsible for all activity performed through your API keys.
12. Conversion Tracking and Data Collection
- The Conversion Tracking module allows you to install a JavaScript pixel on your website(s) to track visitor events.
- By using this feature, you are responsible for:
- Complying with all applicable privacy laws (GDPR, LGPD, CCPA) regarding visitor tracking on your website(s).
- Obtaining necessary consent from your website visitors before activating non essential tracking.
- Providing appropriate privacy disclosures on your website(s) about the use of tracking technologies.
- We hash visitor IP addresses using SHA 256 with a unique salt before storage to protect visitor privacy.
- Tracking data is retained for 90 days and then automatically purged.
13. Abandoned Cart Automation
- The Abandoned Cart module enables automated email sequences to recover abandoned shopping carts detected via the tracking pixel.
- You are responsible for ensuring that automated emails comply with applicable email marketing laws (CAN SPAM, GDPR consent, LGPD).
- Recovery emails are sent only to visitors whose email addresses are captured through your website's forms.
- You can configure email sequences, timing, and optional discount codes.
- Abandoned cart data is retained for 30 days before automatic expiration.
14. Third Party Integrations
- The Service allows you to connect third party platforms (Google, Meta, LinkedIn, TikTok, etc.) via OAuth authorization.
- By connecting a third party platform, you authorize us to access data from that platform within the scopes you approve.
- We are not responsible for the availability, accuracy, or security of third party platforms.
- Each third party integration is subject to that platform's own terms of service and privacy policy.
- You can disconnect any integration at any time, which immediately revokes our access to that platform's data.
- We do not guarantee compatibility with future changes to third party APIs.
15. Intellectual Property
- The Service, including its design, code, features, documentation, and branding, is owned by Virtual 360 ADS and protected by applicable intellectual property laws.
- Your subscription grants you a limited, non exclusive, non transferable license to use the Service for its intended purpose during your active subscription.
- You retain ownership of all data you input or generate through the Service (campaign data, KPIs, reports).
- We do not claim ownership of data you import from third party platforms through OAuth integrations.
- You may not use our name, logo, or branding without our prior written consent.
16. Disclaimer of Warranties
- The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
- We do not guarantee that the Service will be uninterrupted, error free, or free of harmful components.
- We do not warrant the accuracy, completeness, or reliability of any data displayed from third party integrations.
- AI generated insights and recommendations are for informational purposes only and should not be the sole basis for business decisions.
- Marketing performance metrics are displayed as provided by connected platforms and may be subject to those platforms' data processing delays or inaccuracies.
17. Limitation of Liability
- To the maximum extent permitted by applicable law, Virtual 360 ADS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Our total liability for any claims related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
- This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise).
- Some jurisdictions do not allow the exclusion or limitation of certain damages, in which case the above limitations apply to the fullest extent permitted by applicable law.
18. Indemnification
You agree to indemnify and hold harmless Virtual 360 ADS, its owner, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any applicable law or third party rights.
- Content or data you submit or make available through the Service.
- Your use of the tracking pixel or automated emails in violation of applicable privacy or marketing laws.
19. Account Termination
- You may terminate your account at any time through Settings > Danger Zone.
- We may suspend or terminate your account if:
- You violate these Terms or any applicable law.
- Your payment is overdue for more than 30 days.
- Your use of the Service poses a security risk or may harm other users.
- We are required to do so by law.
- Upon termination, your access ceases immediately and your data will be retained for 30 days to allow for data export, after which it may be permanently deleted.
20. Governing Law and Dispute Resolution
- These Terms are governed by the laws of the Federative Republic of Brazil.
- Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good faith negotiation.
- If negotiation fails, disputes shall be resolved by the courts of Sao Paulo, Brazil, unless applicable consumer protection law requires a different jurisdiction.
- For users in the European Union, nothing in this section limits your right to bring proceedings before the courts of your country of residence as permitted under applicable EU law.
21. Severability
- If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
- The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
22. Entire Agreement
- These Terms, together with our Privacy Policy, Cookie Policy, and any supplemental terms for specific features, constitute the entire agreement between you and Virtual 360 ADS regarding the use of the Service.
- These Terms supersede any prior agreements or understandings, whether written or oral.

24. Customer Support and Service Level Agreement
- Virtual 360 ADS provides customer support through an integrated ticket system accessible from your account dashboard. Support availability, response times, and features vary by subscription plan.
- Starter plan: support is available via email and knowledge base during business hours (9:00 AM to 6:00 PM, Brasilia time, Monday through Friday). First response target: 48 business hours. Monthly ticket limit: 5 tickets. Available priority levels: Low and Normal.
- Professional plan: support is available via email and live chat during extended hours (8:00 AM to 8:00 PM, Brasilia time, Monday through Friday). First response target: 12 business hours. Monthly ticket limit: 20 tickets. Available priority levels: Low, Normal, and High.
- Enterprise plan: support is available via email, live chat, and a dedicated support channel, 24 hours a day, 7 days a week. First response target: 4 business hours. Unlimited monthly tickets. Available priority levels: Low, Normal, High, and Urgent.
- Response time targets represent our commitment to provide an initial response within the specified timeframe. These targets are measured during the operating hours applicable to your plan. Response times are not guaranteed and may vary during periods of high demand.
- Support covers questions about platform features, account configuration, billing inquiries, integration setup, and technical issues related to the Virtual 360 ADS platform. Support does not cover general marketing strategy consulting, third party platform issues outside our control, or custom development requests.
- Virtual 360 ADS reserves the right to modify support terms, response targets, and ticket limits at any time. Active subscribers will be notified of material changes.
25. Use of Artificial Intelligence and AI Generated Content
- Virtual 360 ADS incorporates artificial intelligence features powered by third party AI providers. These features include, but are not limited to: AI image generation, AI content creation, marketing intelligence analysis, and an in app virtual assistant.
- All content generated by AI features is provided "as is" for informational and creative purposes. Virtual 360 ADS does not guarantee the accuracy, completeness, originality, or suitability of AI generated content for any specific purpose.
- You are solely responsible for reviewing, editing, and approving any AI generated content before publishing, distributing, or using it in any manner. You must ensure that AI generated content complies with applicable laws, does not infringe third party intellectual property rights, and meets your quality standards.
- AI generated images and text are created based on your inputs and prompts. Virtual 360 ADS does not claim ownership of the content you generate using our AI tools, but we also do not guarantee exclusive rights to similar outputs, as AI models may produce similar results for different users.
- Data submitted to AI features (such as prompts, campaign data, and analysis requests) may be processed by third party AI service providers. We recommend not submitting confidential, proprietary, or personally identifiable information through AI features unless necessary. Refer to our Privacy Policy for details on data handling.
- Usage of AI features is subject to the limits of your subscription plan and, during the trial period, to the trial usage limits described in Section 6.
- Virtual 360 ADS reserves the right to modify, suspend, or discontinue AI features at any time, including changes to the underlying AI models or providers.
26. Email Verification and Account Security
- For your protection, Virtual 360 ADS enables multi factor authentication (MFA) by default on all accounts. When MFA is active, a one time verification code (OTP) is sent to your registered email address each time you log in with your password.
- You may disable MFA from your account settings under Security. Disabling MFA requires confirmation with your current password. We strongly recommend keeping MFA enabled to protect your account from unauthorized access.
- Accounts created or accessed through social login providers (such as Google, Microsoft, Apple, or Meta) are not required to complete additional email verification during login, as identity verification is performed by the login provider. MFA remains enabled on these accounts but the OTP step is bypassed during social login.
- You are responsible for maintaining the security of your account credentials, including your password and access to your registered email address. Virtual 360 ADS is not liable for unauthorized access resulting from compromised credentials or disabled security features.
- Virtual 360 ADS implements additional security measures including encrypted password storage, session management with automatic token refresh, and audit logging of security related account activities.
- If you suspect unauthorized access to your account, you should immediately change your password and re-enable MFA if it was disabled. Contact our support team for additional assistance.
